Kanpur: Additional Sessions Judge Kanpur Nagar Neelanjana on Tuesday dismissed the anticipatory bail suspect’s request Kuldeep Singh for whom a fine was charged sexual exploitation of a girl.
The judge noted in her judgment that the complainant had submitted a petition FIR against suspect Kuldeep who alleged that he had sexually exploited the victim and threatened to kill the victim. The investigation is still on as the victim’s statement could not be recorded under Section 164 CrPC, the judge observed.
Since the charges against the suspect are of a serious nature, for which the penalty is seven years in prison, there are no grounds, taking into account all the facts and circumstances, to grant him provisional bail, the court said in its judgment.
According to additional counsel for the district government, the victim stated in the FIR that she met accused Kuldeep, a resident of Nakipur district Bhiwani (Haryana), through Instagram and exchanged her mobile number during their chat. On April 24, 2023, Kuldeep called and took her to the hotel where he forcibly had physical relations with her. He threatened to kill her if she told anyone about the incident, the victim said in the FIR.
The suspect stated in his bail application that the police had previously filed a final report in the case, citing lack of evidence and recommending investigation, but the intimate relationship between them was not included in the investigation for a year and a half.
The suspect pleaded in court that he is innocent and has no criminal record and promised to cooperate in the investigation. Therefore, he should be granted bail.
